INTRODUCTION. These Terms of Use (“Terms”) govern your use of the “Product Reviews” and “Social Q&A” features (the “Service”) on Stay at Home Shop By submitting Content (as defined below), you are subject to these Terms, as well as the Legal and Privacy Policy (in the event of a conflict, these Terms shall prevail). The Service is provided by Stay at Home Shop, (“Stay at Home Shop”). Please read these Terms carefully, as they constitute a legal agreement between you and Stay at Home Shop. If you do not agree to these Terms, please discontinue using the Service. Stay at Home Shop reserves the right to modify these Terms; you should check these Terms periodically. By using the Service after we post changes to these Terms, you accept those changes, whether or not you have reviewed them.

THE SERVICE. Subject to these Terms, you may use the Service to submit Reviews and Social Q&A (collectively, the “Content”).

“Reviews” means any reviews, comments, opinions, opinions, ratings or reviews of products or services, articles, written expressions, material, text, videos, photographs and information or other data, in any form or medium, provided by you, and/or on your behalf, to Stay at Home Shop.

“Social Questions and Answers” means your questions, and answers to other users’ questions, about the Products provided by you, and/or on your behalf, to Stay at Home Shop.

PROHIBITED USES. You agree that you will not: (i) use, or encourage, promote, promote, facilitate or instruct others to use the Service for any unlawful, harmful or offensive use; (ii) modify, translate, reverse engineer, decompile, disassemble (except to the extent applicable law specifically prohibits such restriction), make any attempt to discover the source code of the Service and/or create derivative works thereof; or (iii) use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of any Content.

LICENSE. For any Content, you grant Stay at Home Shop a worldwide, irrevocable, transferable, perpetual, non-exclusive, sublicensable, irrevocable right and license to use the Content in any manner Stay at Home Shop desires, including, without limitation, to copy, delete in its entirety, adapt, publish all or any part of the Content, translate, create derivative works from, distribute or incorporate it in any form, media or technology throughout the world, in all cases without compensation to you.

REPRESENTATIONS. You are responsible for your Content. By submitting Content, you represent and warrant that:

you are at least 18 years of age, and are the sole author and owner of the intellectual property rights therein;

the Content is accurate and represents your current and honest opinions, conclusions, beliefs or experience;

you have not been promised that your Content will be published or broadcast, nor have you been promised any payment for your Content, and if you have received a free sample of a product that is the subject of your Review, you will disclose that fact in your Review;

the Content (i) does not violate any law, statute, ordinance or regulation, (ii) does not infringe any copyright, patent, trademark, trade secret or other proprietary rights or rights of publicity or privacy of any third party, or (iii) will not cause injury to any person or entity; and

the content is not, and cannot reasonably be considered to be, obscene, defamatory, libelous, slanderous, threatening, hateful, racially or religiously biased or offensive, unlawfully threatening or unlawfully harassing to any individual or entity.

USE OF CONTENT. Your content will not be treated as confidential by Stay at Home Shop or its third party service providers and their respective directors, officers and employees. Accordingly, please do not submit anything that you do not wish to share with the general public (e.g., financial information, social security number, etc.). By submitting your email address in connection with your Content, you agree that Stay at Home Shop may contact you regarding the status of your Content and other administrative purposes. Any Content you submit may be used, or not used, at Stay at Home Shop’s sole discretion, and Stay at Home Shop may refuse, edit for clarity or length, condense or remove Content that Stay at Home Shop believes violates these Terms, or Content that:

is not clear and understandable;

is in a foreign language;

includes details about Stay at Home Shop’s competitors;

includes personal details or information about you or anyone else;

is the same as other reviews submitted by you; or

includes obvious errors (such as text and star ratings that do not generally match, or a review that does not match the product).

PRICING

All of our products are listed in U.S. dollars.

RATES AND CLEARANCE

With respect to product fees, the User will be charged the fees set forth in the applicable section, as offered on the Website. The Rates include the value added tax as provided by the applicable laws in the United Mexican States (16%).

In addition to the purchase price, the purchaser shall be responsible for bearing all taxes arising, including value added, excise, use, privilege, ad valorem, customs and any other similar taxes, levies, fees or charges, taxes imposed or increased by virtue of any law, rule, ordinance or regulation of any municipal, state, federal, international or any other nation with respect to the goods sold to the customer or any part, component or material contained therein, including the importation, processing, distribution, sale or export of raw materials, parts or manufactured goods. Buyer shall also be responsible for any additional expenses incurred by Seller as a result of obligations imposed by municipal, state, federal, international or any other nation’s laws governing labor fees and costs for the production of the goods. In the event that Seller, for any cause whatsoever, shall become obligated to pay such taxes, Buyer shall, upon request, immediately reimburse Seller for such amounts. Buyer shall provide, upon Seller’s request, any tax exemption certificate.

In addition, to the extent required by applicable laws in each country, Users agree to send us duly completed tax forms to enable us to make all required filings with the tax authorities.

Change of Fees. We may change the Fees and/or introduce new charges in addition to the Fees at our sole discretion upon thirty (30) days prior written notice to the User.

Notwithstanding the foregoing, we may increase the Fees, immediately and with contemporaneous notice.

Payment. The price of the Products shall be paid in advance by credit card or other method of payment accepted on the Website.

Packaging – All items will be delivered in a bag or its proper packaging organized as the case may be.

Payment Conditions – In order to ship any product, it will be necessary to cover 100% of the amount including taxes and shipping fees.

Payment Methods: Payments can be made by credit card or debit card accepted.

Delivery Time – Delivery times will be between 04 to 14 business days depending on the volume of orders. This term will start from the next working day of the order and the conformation of the same.

We are not responsible for delays attributable to the customer, nor for changes made to the initial instructions.

We are not responsible for delays in deliveries in case of national emergency, changes in government regulations, changes in customs legislation, trade restrictions, delays in means of transportation and natural disasters. Under no circumstances will Stay At Home Shop pay penalties for late deliveries.

Foreign and International Deliveries – For the shipment of orders to other states, foreign or international, the customer must provide shipping instructions in case there is a special transportation line. Subsequently it will be indicated how much is the amount of the shipment to be paid by the customer.

If you are a customer located outside of Mexico City or in another country, we can ship your orders the day after you request your merchandise using the most appropriate means of shipment for the transportation of your merchandise. The delivery times of the freight forwarding companies depend on the geographic location of each customer.

The cost of freight must be covered in full in order to ship except when the shipment is collect. Prices do not include export customs charges.

Delivery Information – The place and date of delivery shall be determined from the Purchase Order. Once approved, any modification to this information will have an additional cost. The place and date included in our service is unique, if the delivery is to various destinations must be stated from the purchase order and the price will be broken down for each additional destination.

INDEMNIFICATION. You agree to indemnify and hold harmless Stay at Home Shop and its third party service providers, and their respective officers, directors, agents and employees, from and against all claims, demands, damages, costs and expenses of every kind and nature, known and unknown, including, without limitation, reasonable attorneys’ fees, arising out of (i) any Content you submit, (ii) your breach of these Terms, or (iii) your violation of any law or the rights of any third party.

THE SITE, INCLUDING ITS CONTENT, IS PROVIDED “AS IS” STAY AT HOME SHOP AND ITS DIRECTORS, EMPLOYEES, CONTENT PROVIDERS, AGENTS AND AFFILIATES EXCLUDE, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY OR FITNESS FOR A PARTICULAR PURPOSE. STAY AT HOME SHOP SHALL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF THE USE OF THE SITE OR THE https://stayathomeshop.net/ SITE CONTENT, OR THE UNAVAILABILITY THEREOF, INCLUDING, BUT NOT LIMITED TO, LOST PROFITS AND DIRECT, INDIRECT, INCIDENTAL, PUNITIVE AND CONSEQUENTIAL DAMAGES. NO WARRANTY IS MADE THAT THE FUNCTIONS INCORPORATED IN OR THE MATERIALS ON THIS SITE WILL BE UNINTERRUPTED OR ERROR-FREE. STAY AT HOME SHOP offers a search function within the Site. STAY AT HOME SHOP explicitly disclaims any responsibility for the content or availability of the information contained in our searchable index or directory. STAY AT HOME SHOP also disclaims any responsibility for the completeness or accuracy of any directory or search results.

Some countries do not allow the exclusion or limitation of implied warranties or liability for certain categories of damages. Therefore, some or all of the above limitations may not apply to you to the extent that they are prohibited or superseded by state or national provisions.

LIMITATION OF LIABILITY

IN NO EVENT SHALL STAY AT HOME SHOP’S AGGREGATE LIABILITY, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER THEORY, ARISING OUT OF OR RELATING TO USE OF THE WEBSITE EXCEED ANY COMPENSATION YOU PAY, IF ANY, TO STAY AT HOME SHOP FOR ACCESS TO OR USE OF THE WEBSITE.

APPLICABLE LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the United Mexican States.

TERMINATION

Notwithstanding any of these Site Terms, STAY AT HOME SHOP reserves the right, without notice and in its sole discretion, to terminate your account and/or block your use of the Site.

MISCELLANEOUS PROVISIONS

Any waiver of any provision of the Site Terms will be effective only if in writing and signed by STAY AT HOME SHOP. If any provision of these Site Terms is found to be unenforceable, to the extent possible this will not affect any other provision, and each will remain in full force and effect. Any rights not expressly granted herein are reserved.

CHANGES TO SITE TERMS

STAY AT HOME SHOP reserves the right to change any of the terms and conditions contained in the Site Terms or any policy or guideline of the Site, at any time and at its sole discretion. When we make changes, we will revise the “last updated” date at the top of the Site Terms. Any changes will be effective immediately upon posting on the Site. Your continued use of the Site following the posting of changes will constitute your acceptance of those changes. We encourage you to review the Site Terms each time you visit one of our websites.
